Information and Telecommunications
We provide a wide range of legal services related to IT law to a variety of clients, from IT companies to IT departments of existing businesses.
(1) Privacy and data protection
In addition to the Act on the Protection of Personal Information, we provide support for compliance with overseas privacy and data protection laws, including the GDPR. We draft and review privacy policies, establish data governance systems, provide advice on the use of anonymized and pseudonymized information, and draft and review contracts related to cross-border transfers. In case of a data breach, we provide comprehensive legal support, from initial response to reporting to authorities and victim support.
(2) Information security and management
We provide support for establishing information management and security systems based on case law trends and various standards such as ISO 27001. This includes developing information management regulations in conjunction with the introduction of security management systems such as log management, creating employee confidentiality agreements and various internal regulations, providing legal support for contractors (supply chain), developing business continuity plans (BCPs) in anticipation of information security incidents, and providing internal audit support. Furthermore, in case of an actual security incident, we provide comprehensive support, including dealing with authorities, communicating with stakeholders, and providing legal advice related to forensic investigations.
(3) AI and SaaS
We can handle a wide range of legal issues specific to AI and SaaS businesses. With regard to AI, we provide advice not only on legal risks at each stage of development, service provision and use but also on the Copyright Act, the Act on the Protection of Personal Information, and other laws related to the use of learning data. At the service provision stage, we formulate terms of use and policies. Regarding SaaS, we provide advice on implementation in addition to creating terms of use and privacy policies.
(4) Intellectual property
We provide legal advice on intellectual property licensing and the use of open-source software. We also handle all aspects of intellectual property matters, including the establishment of trade secret management systems, patent and trademark applications and enforcement, dispute resolution related to copyright and trademark infringement, and the drafting and negotiation of technology licensing agreements and joint research agreements.
(5) E-commerce
We provide support for the creation of terms of use and privacy policies necessary for operating e-commerce sites, as well as compliance with laws such as the Act on Specified Commercial Transactions, the Act against Unjustifiable Premiums and Misleading Representations and the Consumer Contract Act. We also offer a wide range of legal services related to e-commerce, including support for the design of subscription models and billing models.
(6) Reputation management
We provide legal support for defamation and reputational damage on the Internet through measures such as requests for disclosure of sender information and requests for deletion. We offer comprehensive support for corporate reputation management, including legal advice on crisis management and public relations responses on social media and other media, responses to new reputational risks posed by deepfakes and AI-generated content, and support for the establishment of internal control and monitoring systems to prevent brand damage.
